Resident Service Agreement: What Thai Care Homes Need
A resident service agreement defines services, fees, resident rights, PDPA consent, and exit terms — protecting your care home and earning family trust.
A resident service agreement is the legal contract between a care home and a family before their loved one moves in. In Thailand, elder care businesses licensed by the Department of Health Service Support (สบส.) are expected to have a clear written agreement in place for every resident — both as sound governance and because inspectors routinely review it during assessments.
Why It Matters More Than Operators Think
A well-drafted agreement is not a formality. It prevents the disputes care homes encounter most:
- Billing disagreements vanish when every service line is written down before admission
- Scope of care is clear to staff and families from day one
- Legal standing if a complaint or incident goes further
- Inspection readiness — สบส. auditors regularly ask to see resident agreements as part of their standard review
Key Sections to Include
Parties and Authorised Decision-Maker
Name the care home and its licensed operator, the resident, and the next-of-kin authorised to make decisions on the resident’s behalf — including their national ID numbers.
Services Included and Excluded
Be explicit about what is covered in the standard monthly fee versus what is billed as an add-on. For example:
- Included: accommodation, three daily meals, personal-care support, group activities
- Add-ons: physiotherapy, adult diapers, hospital transport
This section alone prevents the majority of billing disputes before they start.
Fee Structure, Payment Terms and Price Adjustment
State the monthly fee, due date, payment method, and notice required before any price increase (30 days is common). Include a clear policy on refunds or credits if the resident is hospitalised or leaves before the billing period ends.
Resident Rights and Responsibilities
Affirm the resident’s right to privacy, dignity, visitor access, and access to their own health information. State family responsibilities in return — such as providing accurate health history and following the center’s reasonable rules.
Termination Conditions
Cover both sides: how a family gives notice to move out (14–30 days is typical) and the circumstances in which the center may ask a resident to leave — such as care needs that exceed the center’s capability, or persistent non-payment.
Emergency Response Plan
State which hospital is the default in a medical emergency, how staff will notify next-of-kin, and who may authorise medical procedures if the family cannot be reached.
PDPA Consent Inside the Agreement
Care homes hold sensitive health data, and Thai PDPA law requires explicit separate consent for collecting, processing and sharing it. The agreement should specify:
- What data the center collects (health records, medications, assessments)
- Who it may be shared with (family, treating doctors, government authorities)
- The resident’s right to access and correct their data
Keep the PDPA consent as a distinct signed section — not buried in small print. This protects both parties and satisfies a common inspection checklist item.
Common Drafting Pitfalls
- Never guarantee a health outcome — that is outside the care home’s scope and creates legal exposure
- Do not use language that waives the family’s right to health updates
- Review the agreement against your current สบส. licence conditions each year, as permitted services can change between renewal cycles
Connecting the Agreement to Your Digital System
Once a resident signs, their service details, emergency contacts, and PDPA consent should go straight into your resident records system — not sit in a paper file that takes time to find when a สบส. inspector arrives. A centralised record means every staff member works from the same agreed care plan from day one.
